1 Terms and Conditions
Subject to the terms and conditions (the “Terms and Conditions”) as set out below, this website (the “Site”) is provided to you by:
  1. (1) Boots.com (Direct) Limited, Registered Office, 1, Thane Road West, Nottingham, NG2 3AA. Registered England 4077870) which is a wholly owned subsidiary of Boots Group PLC
  2. (2) TUI UK LTD also trading as The First Resort and acting as agent to certain undisclosed principals (“TUI UK”)(company number 2830117) registered as a company in England and Wales with registered offices at Greater London House, Hampstead Road, London, NW1 7SD; together (“the Service Providers”).

2 Acceptance of the Terms and Conditions by You

These terms constitute the entire agreement and understanding between you and the Service Providers. This site (the “Site”) and the associated call centre (the “Call Centre”) (for details about the Call Centre please see clause 4 below) are provided for your personal use subject to these Terms and Conditions. By using this Site or the Call Centre, you are deemed to have understood and accepted these Terms and Conditions (the “Agreement”). If you do not agree to these terms, you may not use the Site or our services provided at the Call Centre.

THESE TERMS AND CONDITIONS DO NOT AFFECT YOUR STATUTORY RIGHTS. NOTHING IN THESE TERMS AND CONDITIONS WILL BE CONSTRUED TO AFFECT YOUR STATUTORY RIGHTS. TUI UK acts as agent only when offering holidays or other similar services for third parties and is not responsible for providing your holiday. Any holiday you purchase using the Site or through the Call Centre (which is confirmed in accordance with these Terms and Conditions, for details please see clause 19 below), will constitute an agreement between you and the tour operator, carrier, hotel or such other provider of services. All bookings you make will be subject to the tour's operator's, carrier's, hotel's or service provider's terms and conditions, copies of which are available on request by contacting Customer Services at the Call Centre on 0870 055 5039 or by e-mail sent bootstravelshop@thefirstresort.com

3 Availability of the Site and the Call Centre
Although TheFirstResort aims to offer you the best possible service, it makes no promise that the services available at the Site or through the Call Centre will meet your requirements, or that the service will be uninterrupted, timely, secure or entirely error free. TheFirstResort may modify or discontinue the Site or the Call Centre with or without notice to you and without liability to you or any third party.

Due to the nature of the internet and the fact that your access to the Site involves features outside TheFirstResort's control, TheFirstResort is not responsible for technical problems that you may experience with the Site or with the Call Centre. However, if you have any technical problems with the operation of the Site or Call Centre, you may contact Customer Services at the Call Centre on 0870 055 6301 or by e-mail sent to info@thefirstresort.com.
4 The Service Provider's Privacy Policy
We take the privacy of your data very seriously. Please read the following policy which describes how we will process and safeguard your personal data.
4.1 Collecting Information
The Service Providers collect data from you in a variety of ways: (i) you provide the Service Providers with information when you register with the Service Providers either on this Site or at the Call Centre; (ii) we obtain information from your use of the Site and other websites that you visit; (iii) we collect information about the purchases you make on our Site and through the Call Centre, including details of your method of payment; and (iv) we monitor collective website patterns in order to improve the service we provide to you. This Collective data will not identify any individual customer.

The collection of this information allows us to deal with your booking or enquiry as smoothly and quickly as possible.
4.2 Ensuring Your Privacy
To process your booking we will have to disclose your personal data to third parties. This includes (i) providing your booking details to tour operators, carriers, hotels and other service providers so that they can provide you with the services you require and for their administration and (ii) passing on your credit/debit card details to our agent(s) in order to process your payment. By inserting a tick in the box below you agree to us disclosing your personal data to third parties for the purpose of processing your booking only. Your personal details may be used, dependant on your response to the Data Protection questions prompted at booking stage , in analysis at an anonymous level by boots.com Direct Limited, Companies within the Boots Group and organisations providing goods and services on behalf of the Boots Group. We would also like to contact you occasionally with details of Boots Group products, services and special offers that may interest you. If you wish to review any of the data protection choices that you have previously made, please telephone 0870 055 5039 will need customer services specific no here (awaiting confirmation)Please note: These consents are separate from any decision you made about receiving information when you registered with boots.com or Boots Advantage Card.
In the unlikely event of a third party purchasing all or part of our assets, or in the unlikely event of us being declared insolvent or ceasing to trade, your data will be passed on to Boots.com Direct Limited.
4.3 Updating your information and consents
You can correct the information that you have provided to the Service Providers on the Site, at any time, by altering your Site user profile. If you have booked a holiday and want to change your details (such as your address) please call and discuss this with our agents at the Call Centre.

4.4 Security
All transactions on the Site and at the Call Centre take place in a safe environment. The Service Providers use a secure server that implements security technology in our on-line ordering process that protects your credit/debit card information and personal data. Your information will be stored in a central database, controlled by our administrative staff and will be accessible electronically. Security measures are in place to ensure that your data is not accessible to unauthorised persons.
4.5 About 'cookies'

Cookies give your computer an important and useful personal identification. They are files attached to your computer's hard-drive by your browser. They enable us to monitor the pages on our website that a computer used by you has accessed. A 'cookie' is a file in your web browser that enables us to recognise your computer when you visit the site.

The tool is used by many Web sites to help collect information, such as how many people visit and return to the site, what products are being bought, and to make certain parts of the site function properly.

5 Prices and Availability
Prices displayed in the search results are starting guide prices. All flights and holidays are subject to availability. They do not include room or flight supplements. All flights and holiday details may be subject to price changes prior to confirmation of your booking. Whilst TheFirstResort regularly updates and checks the price of all the holidays and flights advertised to ensure that they are available at the prices shown, TheFirstResort cannot guarantee the availability of any holiday or flight at an advertised price. The prices shown are based on certain occupancy levels for the accommodation. Please check the correct price which will be made known to you before you book. The prices of holidays and flights are in sterling and are usually quoted inclusive of all taxes unless otherwise indicated.

As with most travel companies, we will levy a card charge for payments equivalent to 2% for all credit cards. There will be no card charges for payments made by debit card.

AI - All Inclusive
Items which are included in the cost of an all-inclusive holiday vary depending upon tour operator, resort and hotel.
AOA - Allocated on Arrival
The tour operator will allocate your accommodation on arrival at the departure airport or resort. It may include accommodation that has not been previously advertised in a brochure.
TOD - Ticket on Departure
If you have booked less than 14 days from the departure date then tickets cannot be sent out to you by post. Instead they can be collected from the appropriate tour operator's ticket desk at the airport. Charges for tickets on departure vary from £0-£15 per person depending upon the tour operator and this will be notified to you at the time of booking. You will need the tour operator's booking reference as stated on the receipt or given to you when you book.
Scheduled flights
If the booking includes scheduled flights, the tickets will be sent by registered post for which a charge of £6 per booking will be made.
6 Prices and Availability
All accommodation ratings including any star ratings are the tour operator's own. They may differ from the accommodation's official rating. Ratings may also differ from one operator to another, depending upon their own individual assessment of the accommodation in question.

Unless stated explicitly Star Ratings shown on the site are not official tourist board ratings. They are based on those awarded by the tour operator as indicated in their brochures. Example: A 1/2 Star could be a Thomson holiday 1/2 T Rating. On a scale of 1-5, 1 is the lowest 5 is the highest.
7 Tickets
Tickets are normally dispatched 14 days before date of departure. If you do not receive your tickets 7 days before date of departure please contact Customer Services on 0870 055 5039 or e-mail bootstravelshop@thefirstresort.com. Please check all tickets carefully as soon as you receive them.

Unless otherwise advised tickets will be sent to the address of the credit/debit card holder. If your ticket has not been paid for prior to the specified ticketing time limit advised by TUI UK or an authorised agent, TUI UK may cancel your reservation. All tickets are non-transferable, non-refundable and non-changeable. Carriage will only be provided to the passenger named in the ticket who may be required to produce appropriate identification. Tickets always remain the property of the issuing carrier and/or the relevant tour operator and will cease to be valid if they are mutilated or altered other than by us or our authorised agent. The ticket for your return or onward journey may not be valid or may cease to be valid if the first part of your ticket has not been used. Further to this passengers may be unable to commence their journey at an agreed stopping place other than that stated as their departure airport on the ticket.
8 Receipts / ABTA membership
Ticket sales are handled by Thefirstresort Operations Ltd. (ABTA J1405), retail agents for ATOL (Air Travel Organisers Licensing) holders. After booking your holiday with TheFirstResort you will be sent a receipt. The ATOL part of the receipt will show the tour operator's ATOL Licence number and details items provided by the tour operator which are covered by the tour operator's ATOL licence from the CAA (Civil Aviation Authority).

9 Insurance

It is essential that all members of your party have adequate travel insurance cover for your trip All travel insurance can be purchased through Boots. Please visit www.Boots.com for more information or call 08456 090 055 (local rate)

Boots Travel Insurance Policy is provided by Boots Insurance Services Ltd and underwritten by New Hampshire Insurance Company. 10 Special Requests
When you book with TheFirstResort, you may wish to make a special request on your booking, for example, if you would like a low floor room or vegetarian meals. TUI UK will do its best to pass these on to your tour operator for you, however, please bear in mind that these are subject to availability from the tour operators and are not guaranteed, unless your tour operator lets you know in writing that they are available.
11 Special Needs/Customers with Disabilities
If you or any member of your party have any medical condition or disability that means you need special travel, accommodation or dietary arrangements, please telephone Customer Services on 0870 055 5039 before you book a holiday. TUI UK can then check with the supplier of your travel arrangement to see whether they can meet these needs.
12 Ages
Registration: It is a condition of this website that only people aged 18 and over are allowed to register.
Bookings: The age of children relates to the whole of the period when they are away including the day of return. If a child's birthday occurs during the holiday (including the date of return) then the new age must be stated. Travel may be refused if the date of birth according to the child's passport disagrees with the age on the tickets. Children under 2 years of age on date of return may count as infants, and may not be entitled to a separate seat on the aircraft. International airline regulations allow only one infant per adult.
13 Passports
Everyone normally requires a valid passport and sometimes a visa to travel abroad. It is your responsibility to ensure that all members of your party have valid passports and visas for your trip, and that the names on the passports of all members of your party match the names on your tickets. British Citizens require a valid full ten-year British Citizen passport for travel outside the British Isles (this includes all children aged under 16 who are not already included on an adult passport). Certain destinations may require at least six months validity remaining on the passport on the date of return. Non British Citizens including other EU nationals should contact the embassy, high commission or consulate of your destination for up to date advice on passport requirements.

If you are applying for a new passport, you can no longer add your children's names onto it - they will need their own individual passports. Children who currently appear on a parent's passport can still travel without an individual passport.

If you need to apply for a new passport, you should do so well in advance of travel to allow plenty of time for your application to be processed. Further information about applications can be obtained from the Passport Office on 0870 521 0410.

TUI UK recommend that all customers should re-check their passport and visa requirements six weeks before they travel.
14 Visas
Visas may be required for British Citizens for entry to non-EU countries. Visas may also be required for longer stays over three months in certain EU countries. Immigration, visa and entry restrictions may apply both in the EU and elsewhere for other nationalities, including other EU nationals, and British Citizens who have conditions on their entry to the UK. Anyone with a criminal record travelling abroad may require a visa. This applies to entry to the USA and to other countries.
15 Health and Safety
Some destinations have particular health requirements. For medical advice regarding your holiday destination or journey, including vaccinations, you should contact your general practitioner. Please do so well in advance of your departure so you can arrange to have any necessary (or recommended) immunisations in good time. It is your responsibility to ensure that all members of your party have made the necessary health arrangements for your trip.

The Department of Health leaflet "Health Advice for Travellers" is available from the Health Literature Line on freephone 0800 555777 or by visiting your local Post Office.

Many tour operators now hand out information leaflets about hygiene and safety abroad as well as covering these points at welcome meetings when you get to your resort. It is wise to follow any advice they provide.

The Foreign and Commonwealth Office (FCO) provides up to date information on safety issues worldwide. You can get this information by clicking here or by phoning the FCO Travel Advice Unit on 020 7238 4503/4504. If you fail to comply with any visa, passport and inoculation requirements, you will be solely responsible for any cost, loss or damage which you, TheFirstResort or your tour operators incur as a result of your failure to obtain the relevant documentation and inoculations.
16 Departure/Arrival Times
All flight timings are shown in "local" time. As flight timings are subject to change, it is important that you check your travel tickets for flight timings. TheFirstResort is not liable if there is any change to a departure/arrival time previously given to you or shown on your ticket. All holidays and flights are for departure from within the UK.
17 Payment
A deposit is payable when the booking is made in accordance with the tour operator's booking conditions. This payment will be required to be made by credit/debit card. All outstanding balances for your holiday are due to be paid to TUI UK up to eleven weeks before date of departure. You can pay your balance by providing your credit /debit card details to Boots Travel Shop customer services on 0870 055 5039 or by sending a cheque. If paying by cheque please copy the reference from the top of the receipt onto the back of the cheque. TUI UK holds payments as agent for the operator or supplier of your holiday or service.

Please note: There is currently no facility for booking and/or making payment online
18 Contract Formation
When you book a holiday or place an order for other services with the Service Providers, whether through the Site or Call Centre, you will enter into a legally binding contract with the tour operator, carrier, hotel offering the holiday or supplier of services. You will be asked to read and accept the tour operator's booking conditions prior to booking including the tour operator's cancellation procedure. This contract will only be formed when the Service Providers either send electronic confirmation of your on-line booking to you (an electronic booking request is a binding offer from you to purchase the flight or holiday on the stated terms, capable of acceptance by us on those terms) or, (where your booking is not made on line), confirm the booking over the telephone to you and dispatch the written confirmation of the booking. If you book for other passengers you accept these Terms and Conditions for yourself and also on behalf of all those people and are responsible for all payments due by them.
19 Cancellation
Once your holiday has been booked, it can be cancelled in writing by the person who made the booking and subject to payment of cancellation charges. All charges (apart from where you have elected to take free travel insurance provided by TFR) are set by the tour operator, carrier or hotel in accordance with their booking conditions, which govern the contract. In the event of cancellation, any charges may be covered by your Travel Insurance - please refer to your policy for information.

Where you cancel and a refund is due this refund will be paid to you on receipt thereof from the relevant tour operator or provider of services. This usually takes several weeks but in some cases may take considerably longer.
20 Cancellation by The Service Providers
The Service Providers reserve the right to withdraw or cancel the service on offer (being the Site and/or the Call Centre). In the event of such withdrawal or cancellation, you will remain bound by the terms and conditions of any tour operator, carrier or hotel with whom you have made any booking.
21 Changes to Terms and Conditions
We reserve the right to change the Terms and Conditions on the site from time to time without notice to you. This will not affect any rights or obligations that you have under any agreement entered into by you on this Site prior to this change. This will also not affect your statutory rights. We therefore recommend that you review these Terms and Conditions from time to time.
22 International Use
The Service Providers makes no representation that materials on the Site are appropriate or available for use in locations outside the United Kingdom, and accessing the Site from territories where its contents are illegal or unlawful is prohibited. If you choose to access this Site from locations outside the United Kingdom, you do so on your own initiative and are responsible for compliance with local laws.
23 Copyright
The material on the Site and made available to you by The Service Providers is protected by copyright and other intellectual property and proprietary rights which belong to TheF Service Providers or other third parties.

Other than for the purpose of personal reference or for booking holidays online, you may not, either in whole or in part, reproduce, copy, republish, download, post, broadcast or transmit in any form or medium any material from the Site without The Service Providers' prior permission in writing.
24 Trade marks
THEFIRSTRESORT.CO.UK, THEFIRSTRESORT.COM, THEFIRSTRESORT, TFR and/or other logo's and marks referenced on this Web site are trade marks (registered or otherwise), which belong to TUI UK in the UK and/or other countries or which have been licensed to TUI UK and or Boots.com Direct Limited by the owner for use on the website. You may not use such trade marks without prior written permission of TUI UK or the owner of the rights in the material. Other product and company names reproduced on the Site may be the trade marks (registered or otherwise) of their respective owners.
25 Indemnification
You agree to indemnify and hold each of the Service Providers and its affiliate companies and their officers and employees harmless from any claim or demand, including reasonable legal fees, made by any third party due to or arising out of your use of the service Provider's service's whether through the Site or the Call Centre, the violation of these Terms and Conditions by you, or the infringement by you, or any other subscriber of your account, of any intellectual property or other right of any other person or entity.
26 Disclaimer
THE SERVICE PROVIDERS DO NOT GUARANTEE THE ACCURACY OR COMPLETENESS OF ANY INFORMATION CONTAINED IN OR PROVIDED IN CONNECTION WITH THE SITE AND THE CALL CENTRE. THE SERVICE PROVIDERS ARE NOT RESPONSIBLE FOR ANY ERRORS OR OMISSIONS OR FOR THE RESULTS OBTAINED FROM THE USE OF SUCH INFORMATION OR FOR ANY TECHNICAL PROBLEMS YOU MAY EXPERIENCE WITH THE SITE OR THE CALL CENTRE.

The information which is displayed on the Site and provided through the Call Centre is derived from a number of sources including the brochures of tour operators whose holidays sells as agents. Most operators and other content providers take great care to try to ensure brochure and or content accuracy but services and facilities may change or be withdrawn and brochures may change from time to time. You are advised to enquire whether any changes have been notified to us before you book your chosen holiday. (1) SHALL NOT BE RESPONSIBLE FOR ANY LOSS OR DAMAGE CAUSED, OR ALLEGED TO HAVE BEEN CAUSED, DIRECTLY OR INDIRECTLY, BY YOUR USE OF THE SITE OR THE INFORMATION CONTAINED ON THE SITE OR OTHERWISE PRESENTED TO YOU BY THE SERVICE PROVIDERS; AND (2) DISCLAIMS ALL CONDITIONS, WARRANTIES, OR OTHER TERMS WHETHER EXPRESS OR IMPLIED BY STATUTE, CUSTOM OR USAGE RELATING TO THE INFORMATION CONTAINED IN OR OMITTED FROM OR SERVICES OFFERED ON THE SITE OR OTHERWISE.

(B) NOTHING IN CLAUSE (A) ABOVE, SHALL BE INTERPRETED TO EXCLUDE OR RESTRICT:

(1) THE LIABILITY OF THE SELLER FOR FRAUD OR FOR DEATH OR PERSONAL INJURY CAUSED BY ITS NEGLIGENCE IN THE COURSE OF ITS BUSINESS (UNLESS LIMITED BY STATUTE); AND (2) THE LIABILITY OF THE SELLER FOR BREACH OF THE TERMS IMPLIED BY SECTION 12 OF THE SALE OF GOODS ACT 1979; AND (3) THE LIABILITY OF THE SELLER FOR BREACH OF THE TERMS IMPLIED BY SECTIONS 13 TO 15 TOWARDS ANY BUYER WHO IS A CONSUMER WITHIN THE UNFAIR TERMS IN CONSUMER CONTRACTS REGULATIONS 1999 OR THE UNFAIR CONTRACT TERMS ACT 1977.
27 Termination
The agreement between you and the Service Providers is formed on the basis of these Terms and Conditions (the "Agreement") shall terminate immediately if you breach these Terms and Conditions The termination of the Agreement or your right to use the Site and Call Centre is without prejudice to any rights, which may have against you in respect of such breach.
28 Jurisdiction
All holidays and flights are for departure from within the UK. The site is not intended for use in jurisdictions outside the UK. All agreements will be made in England and governed by English law and be subject to the exclusive jurisdiction of the English courts.
29 Miscellaneous
In the event that any provision of the Terms and Conditions conflicts with the law under which the Terms and Conditions are to be construed or if any such provisions are held invalid by a court with jurisdiction over the parties to the Terms and Conditions, such provision will at the election of TheFirstResort be deleted and the remainder of the terms of these Terms and Conditions will remain in full force and effect.

Any failure by The Service Providers to insist upon or enforce performance by you of any provision of the Terms and Conditions or to exercise any right under the Terms and Conditions will not be construed as a waiver or relinquishment to any extent of TheFirstResort's right to assert or rely upon any such provision or right in that or any other instance, rather, the same will be and shall remain in full force and effect.

A person who is not a party to this Agreement shall have no right under the Contract (Rights of Third Parties) Act 1999 to enforce any term of this Licence but this shall not affect any right or remedy of a third party which exists or is available apart from under that Act.

The above contact details should also be used if you wish to make a complaint. We will use our reasonable efforts to resolve any dispute or complaint as soon as practicable. If you are not satisfied with resolution of the matter, ABTA has an Arbitration Scheme which can be used for this purpose. 31 Agent for ATOL holders
The air holidays and flights shown are ATOL Protected by the Civil Aviation Authority, and we act as agents for licensed tour operators; the relevant ATOL number is displayed with each holiday shown. The flight bookings we make are also ATOL Protected, except when tickets for scheduled flights are sent to you within 24 hours of payment being accepted, or where your payment is made direct to airlines.
